As the second week ends in the trial of the hip-hop mogul the prosecution is finally building momentum in proving its case, leaving the defence clutching at straws.

Let’s not forget the judge a few times this week told the defence team off. On day nine the judge warned the defence over a sexual line of questioning whilst they were cross examining Kid Cudi. With the jury looking on whilst the judge remonstrated with Comb’s team it was not a good look for the defence.
Let’s also mention the elephant in the room. What the hell is going on with the apple sauce?
Apple sauce this. Apple sauce that. Diddy loves Apple sauce. Who cares? What relevance does it have? None as far as I can see. Poor strategy from the defence.

The only witness that I thought the defence gained a few points with was psychologist Dawn Hughes, a “Blind Expert” meaning that she does not know anything about the main figures in the case so had no bias. However, it transpired that she only worked for prosecution teams and was well paid for doing so. It seemed to me that this was a bias on her part.
Her opinion was confused and inconsistent and she had everyone scratching their heads when she said stated in her testimony that “I do not evaluate offenders.”

One Witness that I thought was credible was one of Diddy’s personal assistants, David James who worked for Combs from May 2007 to May 2008.
He told the court that Sean Combs brought three handguns to confront an associate, Suge Knight at a diner in LA.
Sean’s defence pressed what James was going to do to help the situation. “I was there to drive the car. Respectfully, sir, there was somebody with three guns in close proximity. I didn’t think that was an option,” he said to muffled laughter in court.
Moreover, he stated that Cassie had emailed her mother warning that Diddy had threatened to release “2 explicit sex taps” of her and threatened to hurt her.

When Kid Cudi (Scott Mescudi) who was in a relationship with Cassie at the same time as Diddy journalists arrived to give testimony, he looked very relaxed and calm.
He stated that Combs threatened him with violence if he didn’t stay away from Cassie. It could play a critical role as it is an attempt to build a case that Combs used violence and threats to run a criminal enterprise. His testimony said that his Porsche was burned to a shell and that he believed it was under Combs’s orders. He had no direct proof, but it was clear that it couldn’t have been anyone else.
The prosecutors have got another witness that alleges the Combs arsoned Kid’s car which add credence to his story.
Kid claims that Combs admitted to him that he broke into his house too, to scare him into leaving Cassie alone.
The main thrust for the Feds seems to be to nail Combs on RICO charges which are

(source Nate the Lawyer Twitter)
It would only take two of these to stick and Combs will be facing at least 10 years behind bars.
On Tuesday, the next witness will be Capricorn Clark who was another one of Sean Combs employees who they hope will build a picture of criminal misconduct relating to the above RICO charges.
To get a slam dunk, I think the prosecution need to find Kristina Khorram who was the Chief of Staff at Combs Enterprises, as she was front and centre to the events. At present no one can find her.
Let’s see what next week holds.
